In 1985, Swiss legal philosopher Walter Ott visited Herbert Hart in Oxford and made this record of their meeting, which casts novel light on some of Hart’s ideas. Ott engaged Hart in a fresh encounter with the legal philosophy of Gustav Radbruch, particularly Hart’s and Radbruch’s reasons for a minimum content of justice in law. They also discussed the grudge informer, state responsibility under laws of an earlier régime, and questions of the definition and falsifiability of legal theories. Hart (...) surprisingly reported Hans Kelsen as stating, when they had met at Berkeley in 1961, that Hume (and not Kant, and certainly not Wittgenstein) was the greatest philosopher who had ever lived. Summary This article approaches post-war debates about the relationship between normative political theory and empirical political science from a French perspective. It does so by examining Raymond Aron's commentaries on a series of articles commissioned by him for a special issue of the Revue française de science politique on this theme as well as through an analysis of his wartime dialogue with the neo-Thomist philosopher, Jacques Maritain. Following a consideration of Aron's critique of contemporary approaches to this issue in (...) France, we discuss his own distinctive attempt to draw normative theory and empirical science into the same orbit by tracing the interaction of these two elements in his work from the late 1930s to the mid-1960s. The result is that his oeuvre has often been viewed as purely literary and been largely neglected by trained philosophers. However, by ignoring the philosophical aspects of Borges’s thought, criticism has neglected a vast dimension of his work (...) and has thus frequently misunderstood and misinterpreted many aspects of it. As I have tried to demonstrate in an earlier article, 1 there are important philosophical themes in the short stories of Borges, which have yet to be considered. In the present essay, I take up one of these heretofore neglected themes.We can find perhaps no better example of the literary exposition of Borges’s philosophical ideas than in his short story or cuento, “Averroes’ Search.” 2 There Borges reconstructs for us a culture and an age radically different and temporally distant from our own. He recounts the story of Averroes, the Arab philosopher living in Spain in the second half of the twelfth century. The history of philosophy knows Averroes as one of the great medieval commentators on the works of Aristotle. Borges recreates the historical moment and the passion of Averroes in his task of translating and providing a commentary for the texts of the great Greek philosopher who remains forever distant from him. The story takes as its point of departure Renan’s observation about a curious misinterpretation of Aristotle found in Averroes: “S’imaginant que la tragédie n’est autre chose que l’art de louer...”(p. 180). Borges poses [End Page 320] the question of why Averroes, who had dedicated his life to understanding the work of Aristotle, had so badly misunderstood the concept of tragedy treated by the Greek philosopher. To answer this question, Borges brilliantly employs the faculty of historical imagination in order to think himself back into Averroes’s particular time period and cultural context. The short story presents us with a thesis about the intimate connection between culture and language and the ultimate futility of translation and crosscultural knowledge and comprehension. In the present essay, I wish to argue that the point of Borges’s story about the fate of Averroes is (1) to refute the common view which sees language as an entity neutral with respect to culture and history, and (2) to bring to light the comprehensive nature and scope of particular culturally and historically determined ways of thinking and perceiving the world. These philosophical elements have been neglected by the various literary scholars who have treated the works of Borges. 3 Moreover, Borges anticipates many of the most celebrated epistemological and hermeneutical theories of our day from philosophers such as Gadamer, Davidson and Quine, and presents them in literary form.IThere is a common view according to which the manifold languages of the various peoples and cultures of the world are more or less interchangeable. According to this linguistics of common sense, language is something secondary and accidental which is only an inessential corollary to our basic understanding and perception of the world. Human perception and cognition are thought of as constants for all humans everywhere. A dog will be perceived as a dog regardless of time period, place or culture, and the words we create to represent “dog” in the medium of language are secondary and even arbitrary. As a result, individual words in one language correspond to individual words in another. Dog in English corresponds straightforwardly to Hund in German or perro in Spanish, and nothing could be more simple. The gifted translator is merely someone with a great capacity to memorize words and to effect rapid replacement changes, and translation is regarded as a more or less mechanical process with little room for creativity. The diversity of languages is neither epistemologically necessary nor important, but rather explained as an historical accident as in the etiological tale of the Tower of Babel. We introduce a new logical operator CSTC and show that incorporating this operator into first-order logic enables as to capture the complexity class PSPACE. We also show that by varying how the operator is applied we can capture the complexity classes P, NP, the classes of the Polynomial Hierarchy PH, and PSPACE. As such, the operator CSTC can be regarded as a general purpose operator. We also give applications of these characterizations by showing that P and NP coincide with (...) those problems accepted by two new classes of program schemes , by producing some new complete problems for various complexity classes where the reductions are from first principles and do not use known complete problems , and by giving a simple proof that first-order logic incorporated with the least fixed point operator captures P. For the very first time, Russian readers are offered the translation of one of the most rarely published (in the Arab world) and practically unknown (everywhere else) works of Abū Ḥayyān al-Tawḥīdi (930-1023), “[An Epistle] on Penmanship (Arabic Calligraphy)” (982). As one of those who popularized knowledge, an encyclopedist, an unrivaled master of style and a Mu’tazilite scholar Al-Tawḥīdi, using Adab literature, shares all that was known to him about this form of Arabic literature up until its compilation. In an (...) elegant manner, he reveals its secrets, gives us valuable recommendations, and conveys the universal admiration of the famous sages, writers, scribes, and court secretaries of that time. This epistle is considered the first professional work of this art form in the Arab tradition. At the time this piece was written, the seven “canonical” types of Arabic writing were not yet developed in the form and with the names, we are familiar with now. Nevertheless, this is what makes this treatise even more precious in raising the Adībs as well as the well-educated urban youths of those days. It sheds light on the history of their creation at the initial and, perhaps, the most crucial stage. Ethical decision-making frameworks assist in identifying the issues at stake in a particular setting and thinking through, in a methodical manner, the ethical issues that require consideration as well as the values that need to be considered and promoted. Decisions made about the use, sharing, and re-use of big data are complex and laden with values. This paper sets out an Ethics Framework for Big Data in Health and Research developed by a working group convened by the Science, Health (...) and Policy-relevant Ethics in Singapore Initiative. It presents the aim and rationale for this framework supported by the underlying ethical concerns that relate to all health and research contexts. It also describes a set of substantive and procedural values that can be weighed up in addressing these concerns, and a step-by-step process for identifying, considering, and resolving the ethical issues arising from big data uses in health and research. This Framework is subsequently applied in the papers published in this Special Issue. These papers each address one of six domains where big data is currently employed: openness in big data and data repositories, precision medicine and big data, real-world data to generate evidence about healthcare interventions, AI-assisted decision-making in healthcare, public-private partnerships in healthcare and research, and cross-sectoral big data. These two volumes consist of a critical edition and English translation of the two earliest known Armenian sets of scholia on the Heavenly Hierarchy of Dionysius the Areopagite. Composed in the monastic schools of Erznka in the late thirteenth century, these scholia provide significant insight into how the Heavenly Hierarchy in particular, and Armenian translations of Greek texts in general, were understood by Armenian scholars in the Middle Ages. This editio princeps of the scholia represents a rare critical edition of (...) a native Armenian composition from the medieval period. In addition to the text and translation, these volumes include a textual commentary as well as a critical collation and English translation of a number of scholia from the Armenian version of the Greek scholia on the Heavenly Hierarchy. Najm al-Din al-Katibi's al-Risalah al-Shamsiyyah is a scholarly edition and translation of The Canons of Logic, with additional commentary and notes. Composed by Najm al-Din al-Katibi, a scholar of the Shafi'i school of law, al-Risalah al-Shamsiyyah is the most widely read introduction to logic in the Arabic-speaking world. It has probably enjoyed a longer shelf-life than any other logic textbook ever written, having been in use by madrasa students from the early fourteenth century up until the present day. (...) Stephen Makin presents a clear and accurate new translation of an influential and much-discussed part of Aristotle's philosophical system, accompanied by an analytical and critical commentary focusing on philosophical issues. In Book Theta of the Metaphysics Aristotle introduces the concepts of actuality and potentiality---which were to remain central to philosophical analysis into the modern era---and explores the distinction between the actual and the potential.

The objectives of this book are to provide a new translation of Plato's M eno together with a series of studies on its philcisophical argument in the light of recent secondary literature. My translation is based mainly on the Oxford Classical Text, 1. Burnet's Platonis Opera (Oxford Clarendon Press 1900) Vol. III. In conjunction with this I have made extensive use of R.S. Bluck's Plato's Meno (Cam bridge University Press, 1964). At critical places in the dialogue I have (...) also consulted A. Croiset's Gorgias, Menon (Bude text). My debt ~o two other sources will be clearly in evidence. They are E.S. Thompson's Plato's Meno (London, MacMillan 1901), and St. George Stock's The Meno of Plato (Oxford Clarendon Press, 1894). One of the greatest difficulties facing a translator is to achieve a balance between accuracy and elegance. Literal translations are more likely to be accurate, but, alas, they also tend to be duller. Free translations run into the opposite danger of paying for elegance and liveliness with the coin of inaccuracy. Another hurdle, for a translator of a Platonic dialogue, is posed by the challenge to maintain the conversational pattern and fast moving character of the discussion. This is easier where the exchang~s are short, but much more difficult where Socrates gets somewhat long-winded. (shrink)

A New Work by Apuleius presents what may be the first lengthy Latin text from antiquity to be published in almost a century. The volume reveals that this new work is in fact the lost third book of Apuleius' De Platone et eius dogmate, and provides the key to understanding Apuleius' use and interpretation of Plato.

The basic problem affecting humanitarian law today remains that of its implementation. As of now, requests made by individuals before national courts to assess the compatibility of certain acts with international humanitarian law failed. The present case study and commentaries focus on the decision of a German civil court sitting Bonn to deny the victims of a NATO air raid the right to sue Germany and claim compensation for alleged violations of international humanitarian law.
